The Trump administration has disclosed that more than 100 investigations are currently underway into alleged misuse of the H-1B visa program. As reported by Fox News on November 7, 2025, the Department of Labor (DOL) and the Department of Homeland Security (DHS) announced that they are committing “every available resource” to protect American workers and ensure that the H-1B program operates within its intended purpose.
According to the report, federal officials stated that these investigations stem from concerns that certain employers may have exploited the visa program to undercut U.S. wages, misrepresented job requirements, or displaced qualified American workers. The DOL’s Wage and Hour Division is reportedly reviewing cases involving potential wage violations, improper worksite placements, and misclassifications of foreign professionals.
A DHS spokesperson told Fox News that the administration’s focus is to hold violators accountable while maintaining opportunities for legitimate employers who rely on high-skilled foreign workers. The agencies emphasized that companies found guilty of willful violations could face substantial civil penalties, debarment from future filings, and, in some cases, referral for criminal prosecution by the Department of Justice (DOJ).
Officials also highlighted coordination between the DOL, DHS, and DOJ to share data and identify repeat offenders. The administration noted that this multi-agency effort reflects a broader goal of enforcing immigration laws while prioritizing the interests of the domestic workforce.
The H-1B visa program, designed to allow U.S. employers to temporarily hire foreign workers in specialty occupations, has faced criticism in recent years from both political parties. Supporters say it helps fill critical skill gaps in technology, engineering, and research, while critics argue that loopholes have allowed outsourcing firms to misuse the system.
The administration’s latest actions mark one of the most significant enforcement pushes in recent memory. Officials reiterated that the goal is not to restrict access to skilled labor but to ensure fairness and compliance across all sectors using H-1B workers.
